Enforcement and penalty charges

The following charges apply from 1 April 2024.

Housing Enforcement Notices and Orders

This charge is made we when have to serve a notice or order under the Housing Act 2004, Part 1 except for Hazard Awareness Notices.

Civil Penalty Notices (CPN)

A CPN is a means of enforcement against a private landlord, a managing agent or a letting agent. It is an alternative to prosecution in court.

Each CPN reflects the severity of the offence committed, the size of the landlord's portfolio, their experience in letting or management of properties, and their previous record of offending.

CPN charges – housing offences

We may issue a CPN for the housing offences listed below.

Failure to comply with an improvement notice (Section 30) up to £30,000
Offences in relation to licensing of HMOs (Part 2, Section 72) up to £30,000
Offences in relation to licensing of houses (Part 3, Section 95) up to £30,000
Offences of contravention of an overcrowding notice (Section 139) up to £30,000
Failure to comply with HMO management regulations (Section 234) up to £30,000

CPN charges – smoke and carbon monoxide offences

We may issue a CPN if a private landlord, a managing agent or letting agent has not complied with smoke and carbon monoxide alarm regulations.

CPN charges – energy efficiency offences

We may issue a CPN if a private landlord, a managing agent or letting agent has not complied with energy efficiency regulations.

Registered false or misinformation on the Private Rented Sector (PRS) Exemption Register £1,000
Property is let with an Energy Performance Certificate (EPC) rating of F or G £2,000 if less than 3 months, £4,000 if 3 months or more
